Terms of Service
The 90-second version
- broke 2Brokerage is a technology platform. Your brokerage account is opened, custodied, and operated by Alpaca Securities LLC, a registered broker-dealer and member of FINRA and SIPC.
- You make your own investment decisions. We don't give investment advice. We don't tell you what to buy. Anything you see on the platform — including what other users hold — is information, not a recommendation.
- Investing involves risk. You can lose money, including all of it. Past performance does not guarantee future results.
- By using broke 2Brokerage, you agree to these terms. If you don't agree, don't use it.
- You're responsible for your account. Keep your password and TOTP codes private. Use a strong password. Don't share access.
- We can suspend or close your account for things like fraud, abuse, or violating these terms. We'll tell you why when we can.
- Disputes go to arbitration. Not class actions. Details in Section 16.

1. Who we are
broke 2Brokerage is operated by Feather & Fire LLC ("broke 2Brokerage," "we," "us"). We provide a technology platform for managing a self-directed brokerage account.
We are not a broker-dealer. Securities are offered through Alpaca Securities LLC and/or Alpaca Clearing LLC (together, "Alpaca"), a registered broker-dealer and member of FINRA and SIPC. Alpaca opens, custodies, and operates your securities account, executes your trades, holds your cash, and issues your statements.
When you open an account through broke 2Brokerage, you also agree to:
- Alpaca's Customer Agreement
- Alpaca's Account Application Disclosure
- Alpaca's Margin Agreement (required even on cash-only accounts)
Those are between you and Alpaca. These Terms of Service are between you and us.
2. Eligibility
To use broke 2Brokerage, you must:
- Be at least 18 years old
- Be a US resident with a valid US tax identification number (SSN or ITIN)
- Be legally capable of entering into a contract in your state
- Not be on any US sanctions list (OFAC SDN list, etc.)
- Not be subject to any account restriction imposed by Alpaca, FINRA, or any regulator
- Have an email address you control and can verify
For UGMA/UTMA custodial accounts, you (the custodian) must meet the above. The minor doesn't need to.
3. Your account
Registration
You agree to:
- Provide accurate, current, and complete information
- Promptly update info that changes (especially address, employment, financial profile)
- Not register more than one account per person (unless explicitly authorized — e.g., a custodial account for a different beneficiary)
- Not let anyone else use your account
Security
You are responsible for:
- Keeping your password and TOTP codes confidential
- Notifying us immediately at featherandfire@outlook.com if you suspect unauthorized access
- All activity that occurs under your credentials
We require two-factor authentication. We will never ask for your password, TOTP code, or recovery codes via email, phone, or chat. If anyone does, it's not us.
Identity verification
When you submit your KYC application, we forward it to Alpaca for identity verification. Alpaca may approve, deny, or request additional information. We don't make the approval decision — Alpaca does, under their CIP (Customer Identification Program) obligations as the broker-dealer of record.
If Alpaca denies your application, we'll let you know. We can't override that decision.
4. The platform
What we provide
- A user interface for managing your Alpaca brokerage account
- Tools to research stocks (screener, charts, company profiles, news)
- Order placement, deposit, withdrawal, and transfer interfaces (which submit to Alpaca for execution)
- Optional features like dividend wallet, recurring investments, beneficiary management
- Educational content
- Social features (if and when launched) — see Section 7
What we don't provide
- Investment advice. We don't recommend specific securities, portfolios, or strategies.
- Tax advice. We're not your tax advisor; the dividend and gain/loss views are for your reference, not tax filing.
- Legal advice. Our agreements are written plainly but they're not a substitute for a lawyer.
- Custody. Your money and securities are held by Alpaca, not us.
- Trade execution. Alpaca executes; we just submit your instructions.
5. Self-directed trading
Your account is self-directed. This means:
- You decide what to buy and when
- You decide what to sell and when
- You decide how much to invest
- You decide how to allocate across accounts (Brokerage, Roth IRA, etc.)
We provide information — prices, market cap, news, what's in the screener — but information is not advice. We don't know your full financial situation, your tax position, your time horizon, or your goals. Only you do.
If you want personalized investment advice, work with a Registered Investment Adviser (RIA). We're not one.
6. Investing involves risk
Investing in securities involves substantial risk, including the risk of losing all or part of the money you invest. Specifically:
- Stock prices fluctuate. They can go to zero.
- Past performance is not a guarantee of future returns.
- Diversification reduces but does not eliminate risk.
- Market events, economic conditions, and company-specific events can cause sudden, large losses.
- Dividends are not guaranteed and can be cut or eliminated by issuers.
- ETFs and mutual funds carry expense ratios, tracking errors, and other costs that affect returns.
- Margin trading amplifies both gains and losses and can result in losses greater than your initial investment.
You should only invest money you can afford to lose. If you're unsure whether investing is right for you, talk to a financial professional who can review your full situation.
7. Social features
The platform may show you information about what other broke 2Brokerage users hold or are buying ("social features"). This information is:
- Not investment advice from us, from Alpaca, or from those users
- Not a recommendation to buy, sell, or hold any security
- Not a guarantee that those users will be right — they can lose money on those positions
Don't blindly copy what other users do. Your circumstances are different.
We may anonymize or aggregate trading activity for display. You can opt out of having your activity shown to others in your account settings (when available).
8. Fees
broke 2Brokerage is currently free to use.
We do not charge a subscription or platform fee at this time. We may introduce fees in the future (for example, a subscription or premium tier). If we do, we'll give you at least 30 days' notice by email before any fee takes effect. As always, you're free to close your account at any time (see Section 18).
A few things to know either way:
- No commissions on equity trades. (Market makers may take a small spread on execution, which is normal for all retail brokers — see Alpaca's disclosures for details.)
- Order execution and payment for order flow. broke 2Brokerage does not itself receive payment for order flow. Your trades are executed by Alpaca; like most commission-free brokers, Alpaca may receive payment for order flow or otherwise earn on execution. See Alpaca's disclosures for details. We disclose how this works rather than obscure it.
- Pass-through fees still apply. Certain Alpaca charges — such as outgoing wire transfers, returned ACH transfers, or paper statements — are not ours, but may be passed through to you. These are listed in Alpaca's brokerage fee schedule.
9. Acceptable use
You agree NOT to:
- Use the platform for any illegal purpose
- Misrepresent your identity or any account information
- Reverse-engineer, decompile, or scrape the platform beyond what's allowed by robots.txt
- Use bots, scripts, or other automated means to interact with the platform (unless we explicitly authorize an API)
- Attempt to gain unauthorized access to any account or system
- Interfere with the platform's operation (DDoS, abuse rate limits, etc.)
- Use the platform to manipulate markets, engage in wash trading, layering, spoofing, or any other prohibited trading practice
- Use the platform on behalf of someone else without our written authorization
- Resell, sublicense, or commercially exploit the platform
Violations can result in immediate account suspension or closure, and may be reported to Alpaca or law enforcement.
10. Intellectual property
The platform — including all software, designs, text, graphics, and trademarks — is owned by broke 2Brokerage or its licensors. You get a limited, revocable, non-transferable license to use it for your personal investing.
You retain ownership of content you submit (questions to support, beneficiary designations, etc.).
Stock data, company profiles, logos, and similar information come from third-party data providers and from Alpaca, and are subject to their terms.
11. Suspension and termination
When we can suspend or close your account
- You violate these Terms or Alpaca's customer agreement
- We're required to by law or regulator
- We reasonably believe your account is being used for fraud, money laundering, or other illegal activity
- Your KYC information becomes outdated and you don't update it after we ask
- Inactivity for 24+ months
- Alpaca closes your underlying brokerage account for any reason
When we suspend or close, we'll tell you why if we can. Some reasons (suspected fraud, regulatory requirement) may legally prevent us from explaining.
When you can close your account
You can close anytime by emailing featherandfire@outlook.com. We'll initiate Alpaca's account-closure process. You'll need to transfer or sell holdings and withdraw cash before closure can complete (Alpaca's rules).
After closure
- We keep KYC and transaction records for at least 6 years (SEC requirement).
- All other data is deleted within 90 days unless legally required.

12. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- The platform will be uninterrupted, secure, or error-free
- Information shown is accurate, complete, or current (market data and company info come from third parties on a best-effort basis)
- Bugs will be fixed within any specific time
- The platform will be available in all locations or at all times
Market data can be delayed, incorrect, or unavailable. Always confirm critical decisions against your account on Alpaca's side and against authoritative sources before acting.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any investment losses you incur. The market does what the market does. We don't promise gains.
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
- Our total liability to you for any claim arising out of or relating to the platform is limited to the greater of $100 or the fees you paid us in the 12 months preceding the claim.
- Nothing in these Terms limits liability for fraud, willful misconduct, or anything that can't be limited by law.
14. Indemnification
You agree to indemnify and hold broke 2Brokerage, its officers, employees, and affiliates harmless from any claim, loss, damage, or expense (including reasonable attorneys' fees) arising from:
- Your violation of these Terms
- Your violation of any law or third-party right
- Your use of the platform in ways outside the scope of these Terms
- Inaccurate information you provided
- Activity that occurs under your account credentials
15. Independent contractor / no agency
We are not your agent, fiduciary, trustee, or attorney. Nothing in these Terms creates a partnership, joint venture, or employment relationship. Alpaca is a separate company; we don't speak for them and they don't speak for us.
16. Disputes — arbitration and class-action waiver
Your relationship with us matters. Resolving your concerns fairly and promptly is one of our top priorities, and we will always work with you in good faith to understand and remedy any issue before it becomes a formal dispute.
If you have a concern, email featherandfire@outlook.com and we'll do our best to make it right. If a dispute still can't be resolved that way:
Binding arbitration
Any dispute arising out of or relating to these Terms or the platform will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator's decision is final and enforceable in court. The seat of arbitration is Iowa. Each side bears its own costs unless the arbitrator orders otherwise.
Class-action waiver
YOU AND BROKE 2BROKERAGE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
Exceptions
Regardless of the above, you can always report concerns to FINRA, the SEC, your state securities regulator, or any other government authority.
Opt out
You can opt out of arbitration within 30 days of first agreeing to these Terms by emailing featherandfire@outlook.com with the subject "Arbitration opt-out" and your account email. Opting out doesn't affect any other provision of these Terms.
17. Governing law
These Terms are governed by the laws of Iowa, without regard to conflict-of-laws principles.
18. Changes to these Terms
We may update these Terms. When we do:
- We'll update the "Last updated" date at the top.
- If the change is material (affects your rights or obligations), we'll notify you by email at least 30 days before it takes effect.
- Continued use after the effective date means you accept the updated Terms.
- If you don't accept a change, close your account before the effective date.
19. Miscellaneous
- Severability. If any part of these Terms is unenforceable, the rest stays in effect.
- Entire agreement. These Terms (plus the Privacy Policy and any agreements with Alpaca) are the complete agreement between you and broke 2Brokerage about the platform.
- No waiver. If we don't enforce a provision, that's not a waiver of our right to enforce it later.
- Assignment. You can't assign these Terms. We can, with reasonable notice (e.g., in a merger or acquisition).
- Survival. Sections about disclaimers, liability, indemnification, and disputes survive termination.
